Qualified Immunity Under Attack – Analysis of Current Attention, Application, and Attempts at Abolishment
Our follow-up Qualified Immunity session took a deeper dive into how QI has changed over time, specifically in our judicial and legislative systems. Each panelist discussed a different angle to the changes, including an analysis of QI at the appellate and Supreme Court level; a discussion of Congress’ legislative action to reform and/or abolish QI coverage for government and municipal employees; and, an introduction to Colorado’s newly passed Law Enforcement Integrity Act (which effectively removes the QI defense for municipal police officers) and how it impacts police liability claims for the pool.
